Overview of ESAs
As defined by the U.S. Department of Housing and Urban Development (HUD), an emotional support animal (ESA) is any animal that provides emotional support to an individual in an effort to alleviate one or more symptoms of their disability. Although all pets provide some form of emotional connection, ESAs specifically support mental and emotional health conditions.
Over time, the popularity of ESAs has grown in the United States as a way for more people to house pets in their residential apartments. The Fair Housing Act requires landlords to accommodate assistance animals, including those used for emotional support. As ESAs do not require any specialized training, fraudulent claims of mental health disability can be made to force property managers to accommodate pets.
Publicly Available Data on ESAs
In order to receive housing accommodation, an ESA should be prescribed by a mental health professional to a person with a mental disability. The industry standard is that it should be re-evaluated annually whether for housing accommodations or travel requiring documentation.
The data shows that 19.2% of Americans seek mental health treatment in a given year.
After interviewing several licensed medical health professionals, we learned that, on average, they write ESA letters for less than 10% of their patients. Given the average household size of 2.5 people, less than 5% of prospective tenants should have a valid ESA letter.

Through data collected for case studies, landlords typically report that between 40%-87% of units are housing an ESA. This statistic is significantly higher than what should be expected based on public data, meaning that a sizeable number of ESA letters are indeed fraudulent.
There are a plethora of online websites that offer to sell ESA letters to virtually anyone if you simply say that you “sometimes” feel anxious and that you believe a pet would help. Some of these sites boast that 99% of applicants qualify for an ESA letter. These types of online letters are not appropriately prescribed and are considered to be fraudulent. It varies from property to property, but OurPetPolicy typically flags between 50%-70% of ESA letters as fraudulent.
Verifying ESA Letters is Crucial
Renters who abuse the ESA system typically do so for two main reasons — it allows them to house a pet in units where pets are prohibited, or it permits them to have a pet on property at no cost, avoiding any required pet fees and deposits.
By verifying ESA letters, you can start to collect fees and deposits from renters who currently aren’t paying them, adding more revenue to your bottom line. And as any property manager knows, the presence of pets means damage to your property. Collecting deposits ensures that you can appropriately fund the costs of any pet-related damage in and around units.
